Terms of service

Who this is between

These terms are between Botly Solutions (“we”, “us”) and the business that opens a Dots account (“you”, “the café”). By creating an account or using the product you accept them.

What Dots is

A point-of-sale and back-office product for cafés and restaurants in Saudi Arabia: taking sales, issuing ZATCA-compliant invoices, managing a menu and stock, a guest-facing menu, a loyalty card, and a shared inbox for customer messages from connected WhatsApp, Instagram, Facebook and TikTok accounts.

We may add, change or withdraw features. Where a change removes something you rely on, we will give you reasonable notice.

Your account

• You are responsible for what your staff do with their accounts, and for removing access when someone leaves.
• Give us accurate business details. Your VAT number and trading name appear on every invoice you issue, and a wrong one is your liability, not ours.
• Keep sign-in credentials and device PINs confidential. Tell us promptly if you think an account has been compromised.

Your data is yours

You own the data you and your customers put into Dots. We hold it to run the service for you, on the terms in our privacy policy, and for no other purpose. We do not sell it and we do not use it to advertise.

You can export your data while your account is active, and you can ask us for a copy when you close it.

Messaging, and the rules that come with it

When you connect a WhatsApp, Instagram, Facebook or TikTok account you are also agreeing to that provider’s own terms and policies, and you remain responsible for what you send.

• Only message people who have given you a reason to expect it. Unsolicited marketing is the fastest way to have a number restricted by the provider, and that restriction is applied to you, not to us.
• A provider may limit, suspend or remove your account under its own rules. We cannot overrule that and we are not liable for it.
• Template messages must be approved by the provider before they can be sent, and approval is the provider’s decision.
• You must honour an opt-out. Dots records one when a customer asks to stop, and will not send to them again.

Acceptable use

Do not use Dots to:

• break any law, including Saudi tax, e-invoicing and data-protection law;
• send unlawful, deceptive or harassing messages;
• issue an invoice for a sale that did not happen, or otherwise falsify a record;
• attempt to reach another café’s data, probe our systems, or work around a limit we have set;
• resell the product without a written agreement with us.

Sales records cannot be edited

A completed sale is permanent. Corrections are made by issuing a reversing record, never by editing or deleting the original. This is what ZATCA and any real audit require, it applies to us as much as to you, and it is not something support can override on request.

Fees

Subscription fees, the billing period and any usage charges are those quoted to you when you sign up. Fees are exclusive of VAT unless stated. We will give you at least 30 days’ notice before a price change takes effect.

Card processing fees are charged by the payment processor under its own agreement with you.

Availability

We work to keep Dots available, and the point of sale is built to keep taking orders while the internet is down, syncing when it returns. We do not promise uninterrupted service, and features that depend on a third party — card payments, message delivery, Google reviews — depend on that third party being available too.

Ending it

• You may close your account at any time. Fees already paid for the current period are not refunded unless we have agreed otherwise.
• We may suspend or close an account that breaks these terms, that puts the service or other cafés at risk, or that is unpaid after we have asked. Except where the risk is immediate we will warn you first.
• After closure we delete your data as described in the privacy policy, except records the law requires us to keep.

Liability

Nothing here limits liability that cannot lawfully be limited. Subject to that, we are not liable for indirect or consequential loss, for lost profit, or for loss caused by a third-party provider’s act or outage. Our total liability in any twelve-month period is limited to the fees you paid us in that period.

You are responsible for the accuracy of what you record in Dots, including prices, VAT treatment and the content of messages you send.

Governing law

These terms are governed by the laws of the Kingdom of Saudi Arabia, and the courts of the Kingdom have jurisdiction.
